Vertragsabschluss | Gültigkeit
Ein Vertrag zur Durchführung einer Fremdenführung inklusive Nebenleistung kommt erst mit erfolgter schriftlicher Buchungsbestätigung zustande. Jede nachträgliche Programmänderung oder Änderung der Personenanzahl seitens des Auftraggebers muss bis maximal 3 Tage vor Programmbeginn schriftlich dem Auftraggeber mitgeteilt werden. Im Falle von Änderungen behalten wir uns vor die Führungsentgelte neu zu kalkulieren.
Stornobedingungen
Stornierungen müssen schriftlich an den Auftraggeber erfolgen.
- Bis 21 Tage = 0 % : Eine Stornierung ist bis 21 Tage vor der Führung kostenlos möglich.
- 20 – 3 Tage = 50 % : Bei Absage bis 3 Tage vor der Führung sind 50 % des vereinbarten Führungsentgelt zu bezahlen.
- Weniger als 72 Stunden = 100%: Bei einer Absage weniger als 72 Stunden vor der Führung ist das volle Führungsentgelt fällig.
Verspätung | Wartezeit
Bei Verspätung des Gastes bleibt das vereinbarte Führungsentgelt ohne Abzug fällig. Die Wartezeit wird jeweils in die Führungsdauer eingerechnet. Im Falle der Verspätung des Kunden ist der Fremdenführer verpflichtet, 30 Minuten am vereinbarten Treffpunkt auf den Kunden zu warten. Der Kunde verpflichtet sich seinerseits, 15 Minuten auf den Fremdenführer zu warten. Bei Nicht-Erscheinen des Kunden gilt die Führung als durchgeführt und es der gesamte vereinbarte Führungsentgelt zur Zahlung fällig.
Verhinderung
Im Falle einer unvermeidbaren Verhinderung des Fremdenführers kann ein fachlich gleichwertig befugter Ersatz vermittelt.
Aufzeichnungen
Video- und Tonaufnahmen sind während der Führung nicht gestattet.
Copyright
Die Titel und der Inhalt aller Führungen von Anita Kuhn e.U. sind geistiges Eigentum von Anita Kuhn e.U. und urheberrechtlich geschützt.
Zahlungsbedingungen
Die Bezahlung erfolgt abzugsfrei gemäß der schriftlichen Vereinbarung. (In Bar vor der Führung, nach Rechnungslegung innerhalb der vereinbarten Frist oder im Voraus). Bei der Buchung eines Beförderungsmittels (Bus, Minibus, Auto) oder anderen Auslagen im Namen des Kunden, ist der vereinbarte Preis innerhalb der genannten Frist vorab auf das Konto (Oberbank | Anita Kuhn | Iban…..) zu überweisen. Bitte bei Überweisungen die Rechnungsnummern und das Datum der Führung angeben, damit wir die Zahlung korrekt zuordnen können.
Umsatzsteuer
Alle Preise verstehen sich als umsatzsteuerfreie Leistung gemäß § 6 Abs. 1 Z 27 UstG.
Haftungsausschluss
Die Teilnahme an den Führungen erfolgt auf eigene Gefahr. Für Schäden an Personen oder Eigentum wird keine Haftung übernommen. Für Führungen sind geeignete Ausrüstung (rutschfeste Schuhe, Regenbekleidung) und die entsprechende Kondition erforderlich. Änderungen aufgrund von Schlechtwetter bleiben dem Fremdenführer vorbehalten.
WIDERRUFSRECHT | AUSSCHLUSS VOM WIDERRUFSRECHT
Der Gast hat grundsätzlich das Recht diesen Vertrag binnen 14 Tage ohne Angabe von Gründen zu widerrufen. Kein Widerrufsrecht hat er in folgenden Fällen:
1) Bei Kauf von Eintrittskarten für eine bestimmte Tour besteht kein Widerrufsrecht! So sind Dienstleistungen, die im Zusammenhang mit Freizeitbetätigungen erbracht werden, sofern jeweils für die Vertragserfüllung durch den Unternehmer ein bestimmter Zeitpunkt oder Zeitraum vertraglich vorgesehen ist, gemäß § 18 Abs 1 Z 10 FAGG vom Widerrufsrecht ausgeschlossen. Der Gast hat daher kein Recht, den Kaufvertrag über die Eintrittskarten zu widerrufen.
2) Bei Wert-Gutscheinen. Bei dem Kauf von Wert-Gutscheinen hat der Gast das Recht den Vertrag binnen 14 Tagen ab Vertragsabschluss ohne Angabe von Gründen zu widerrufen, sofern das Widerrufsrecht nicht vorher erlischt. Der Kunde hat kein Rücktrittsrecht, wenn er den Wert-Gutschein innerhalb der Widerrufsfrist einlöst und im Gegenzug ein Veranstaltungsticket für einen bestimmten Termin erhält bzw. ich – auf Grundlage eines ausdrücklichen Verlangens des Verbrauchers zur vorzeitigen Erfüllung der Dienstleistung sowie einer Bestätigung über dessen Kenntnis vom Verlust des Widerrufsrechts bei vollständiger Vertragserfüllung – noch vor Ablauf der Widerrufsfrist meine Dienstleistung vollständig erbracht habe.
Gerichtsstand, Rechtswahl
Der Gerichtsstand ist Wien. Es gilt österreichisches Recht.

Contractual terms | validity of contract
A contract for the carrying out of the guided tour including additional services is only concluded after receipt of a written booking confirmation. Any subsequent changes of program or number of participants have to be communicated by the customer in writing to the contracting authority latest 3 days prior to the beginning of the guided tour. In case of any requested changes, we reserve the right to recalculate our prices.
Cancellation policy
Canellations have to be done in writing to the contracting authority.
- Up to 21 days = 0%: The cancellation is free of charge up to 21 days prior to the beginning of the guided tour.
- 20 – 3 days = 50% : In case of cancellation up to 3 days prior to the beginning of the guided tour, 50% of the agreed price has to be paid.
- Less then 72 hours = 100% : In case of a cancellation less than 72 hours prior to the beginning of the guided tour, the full agreed price has to be paid.
Delay | waiting period
In case of any delay of the customer, the agreed price remains due without deduction. The waiting time is calculated into the total duration of the guided tour. In case of delay of the customer, the tour guide is obliged, to wait 30 minutes at the agreed meeting point. The customer is obliged to wait at least 15 minutes for the tour guide. In the event of non-appearance of the customer, the guided tour is considered to be carried out and the entire agreed price is due for payment.
Hindrance
In the event of an unavoidable hindrance the tour guide, an equally qualified substitute for the guided tour will be recommended.
Recordings
Video and audio recordings are forbidden during the entire guided tour.
Copyright
The titles and content of all guided tours by Anita Kuhn e.U. are intellectual property of Anita Kuhn e.U. and protected by copyright.
Payment
Payment is to be made without deduction in accordance to the agreed payment conditions (In cash prior to management, after receipt of invoice within the agreed period or in advance). When booking means of transport (bus, minibus, car) or in case other expenses on behalf of the customer, the agreed price must be paid in advance by bank transfer to following account (Upper Bank | Anita Kuhn | Iban…..). Please provide the invoice numbers and the day of the guided tour, so that we can assign the payment accordingly.
Vat
All prices are a VAT-free service according to Section 6 (1) Z 27 UstG.
Liability
The participation in guided tours is at your own risk. No liability will be accepted in case of any damage of persons or property. Appropriate equipment (slip-resistant shoes, rainwear) is required in accordance to the weather conditions. Changes due to bad weather are reserved to the tour guide.
RIGHT OF WITHDRAWAL | EXCLUSION FROM THE RIGHT OF WIHTDRAWAL
In principle, the guest has the right to withdraw from this contract within 14 days without giving reasons. He has no right of withdrawal in following cases:
1)There is no right of withdrawal when buying tickets for a particular tour! Services provided for leisure activities on a specific date or period, are excluded from the right of withdrawal in accordance with Section 18 (1) Z 10 FAGG. The guest therefore has no right to withdraw from the brokered purchase contract for the tickets.
2) For value vouchers. In the case of the purchase of value vouchers, the guest has the right to withdraw from the contract within 14 days of the conclusion of the contract without giving reasons, provided that the right of withdrawal does not expire in advance. The customer has no right of withdrawal if he redeems the value voucher within the withdrawal period and in return receives an event ticket for a specific date or I – on the basis of an express request of the consumer for the early performance of the service as well as a confirmation of his knowledge of the loss of the right of withdrawal in the event of complete performance of the contract – have provided my service in full before the expiry of the withdrawal period.
Place of jurisdiction, applicable law
The place of jurisdiction is Vienna. Austrian law applies.
